Consumer Health Data Privacy Policy

Washington and Nevada each require a separate policy for consumer health data. If you live in either state, read the one for your state below. Our Privacy Policy covers everything else.

FANACARE WASHINGTON CONSUMER HEALTH DATA PRIVACY POLICY

Effective date: [DATE OF LAUNCH].

FanaCare LLC (“we”) publishes FanaCare. This policy describes the consumer health data FanaCare handles, as Washington’s My Health My Data Act requires. Our general Privacy Policy covers everything else.

1. What Health Data Does FanaCare Handle?

On your phone, where we can’t access it, FanaCare holds medications, doses and medication label photos; appointments with health care providers and therapists; health information in IEPs and other documents you add; transcripts of meetings you record; notes about your child’s health or care; and your consent history.

On our servers, we hold your account details and a device identifier, which link you to an app for special-needs care; your app settings; and records of the deletion requests you make.

2. Why Do We Handle It?

On your phone, FanaCare uses this data to provide the features you use: reminders, the medication log, document organization, transcription, and sharing with the helpers you invite. On our servers, we use it to run and secure your account and to keep a record of your deletion requests.

3. Where Does It Come From?

The data comes from you, when you enter, photograph, upload or record information; from the caregivers and nurses you invite, when they log a dose or add a note; and from your phone’s built-in AI, which reads, organizes and transcribes what you add.

4. Who Receives It?

Content on your phone goes only to the people you invite, limited to what you let them see. You can share the types of content listed above with caregivers and nurses you invite. Shared entries pass through our relay in encrypted form that we can’t read. Data on our servers goes to our service providers that host our servers and collect crash reports for us, under contracts that limit them to our instructions. We don’t sell consumer health data.

5. What Are Your Rights?

You can ask us to confirm whether we collect, share or sell your consumer health data, and get access to it. You can get a list of all third parties and affiliates we have shared or sold it to, with an active email address or other online way to contact those third parties. You can withdraw your consent to our collection and sharing of your consumer health data, and you can ask us to delete it.

6. How Do You Make Or Appeal A Request?

To make a request, use the settings in the app or email [email protected]. We may ask for information reasonably needed to check that the request is yours or made on your behalf. You don’t need to create a new account. We’ll act on your request without undue delay and within 45 days after receiving it. Checking your request doesn’t extend that time. If the number or complexity of your requests makes more time reasonably necessary, we may take up to 45 more days, once, and we’ll tell you why within the first 45 days.

For deletion requests, we delete the data from our records and network and tell everyone we shared it with to delete it too. Deletion from archived or backup systems may take up to six months after we verify your request, but only as needed to restore those systems.

If we decline, you can appeal through the app or by emailing [email protected] with “appeal” in the subject line, within a reasonable time after our decision. We’ll answer in writing within 45 days after receiving your appeal and explain our decision. If you disagree with our answer, you can contact the Washington Attorney General. If we deny your appeal, we’ll give you an online way to submit a complaint, if one is available, or another way to contact that office.

On our servers, we hold your account details and a device identifier, which link you to an app for special-needs care; your app settings; and records of the deletion requests you make.

2. Why And How Do We Handle It?

On your phone, FanaCare uses this data to provide the features you use: reminders, the medication log, document organization, transcription, and sharing with the helpers you invite. On our servers, we use it to run and secure your account and to keep a record of your deletion requests. Your phone uses Apple’s or Google’s on-device AI to read, organize and transcribe your content. Our servers store and use the account information, settings and records listed above.

3. Where Does It Come From?

The data comes from you, when you enter, photograph, upload or record information; from the caregivers and nurses you invite, when they log a dose or add a note; and from your phone’s built-in AI, which reads, organizes and transcribes what you add.

Shared entries pass through our relay in encrypted form that we can’t read. Data on our servers goes to our service providers that host our servers and collect crash reports for us, under contracts that limit them to our instructions. We don’t sell consumer health data. We don’t use third parties to collect your consumer health data over time and across different websites or online services.

5. What Are Your Rights?

You can ask us to confirm whether we collect, share or sell your consumer health data, and get a list of all third parties we have shared or sold it to. You can withdraw your consent, ask us to stop collecting, sharing or selling your consumer health data, and ask us to delete it.

6. How Do You Make Or Appeal A Request?

To make a request, use the settings in the app or email [email protected]. We may ask for information reasonably needed to verify your request. If we can’t verify it after reasonable efforts, we don’t have to act on it. We’ll respond without undue delay and within 45 days after verifying your request. If the number or complexity of your requests makes more time reasonably necessary, we may take up to 45 more days, and we’ll tell you why within the first 45 days after verification.

For deletion requests, we delete the data from our records and network and notify everyone we shared it with within 30 days after verifying your request. Those recipients must delete it within 30 days after receiving our notice. The extra response time above doesn’t extend these deletion deadlines. Deletion from archived or backup systems may take up to two years after we verify your request, but only as needed to restore those systems.

If we decline, you can appeal through the app or by emailing [email protected] with “appeal” in the subject line. We’ll answer in writing within 45 days after receiving your appeal and explain our decision. If you disagree with our answer, you can contact the Nevada Attorney General. If we deny the action you asked for in your appeal, we’ll give you that office’s contact information.

7. How Do You Review And Change Your Data?

You can review and change the content you keep on your phone in the app, and request changes to your account information through the app’s settings.

8. How Will We Tell You About Changes?

We’ll tell you about material changes to this policy through a notice in the app.
